Utah Division Of Air Quality A Witness of One


Overwhelming Opposition to Governor Gary Herbert's Proposed Ban On Solid Fuel/Wood Burning


Salt Lake County Public Comment Session January 15, 2015 Time: 6:00 pm.


I arrived at, what I thought would be plenty of time to get a seat and set up my camera to record the proceedings.  I was HAPPY to see the meeting was going to be well attended.  I observed 2 local news agencies there, ABC4 and FOX13, although there could have been others, those are the two I noticed.  It was a steady stream of people filing through the front doors at the Department of Environmental Quality Building.  The meeting room had two entrances, the room set up to accommodate around 250 people, the room was already full beyond capacity, I would estimate around 350 people were in attendance.  I could hardly get in the door, but was hopeful I would find a place for good viewing and my small camera.  To no avail!  I decided to scavenger the outskirts of the room in hopes of finding a spot.  I did get lucky and found an empty seat on a row towards the front.

I had prepared a statement of opposition in hopes that I could speak, but after filling out the paperwork, the meeting was called to order.  I'm not an expert at these things, but as I understand it, you have to have your papers filed before the meeting starts.  I was nervous.  I didn't know if I was in the minority in my opposition or not.  The woman conducting the meeting gave the rules, in short she said, "there are over 60 people who want to speak, [they] were going to allow people 3 minutes, but do to the many who wanted to take a turn, the limit was now 2 minutes.  This would take around 1 1/2 hours.  Don't repeat what someone else has said.  Let's get started!"  In short, this is what I observed.

I was pleased to see that there was overwhelming opposition to the proposed ban.  There were only from 7 to 10 people who addressed the board who advocated for it.  Although we were asked not to repeat ourselves, it happened.  I can't fault people though, for it is their forum to express themselves.  In the beginning there were several "stakeholders", as the government like to call them, we are just the huddled masses!  They included businessmen and organization heads advocating for the ban, including Dr. Brian Moench an anesthesiologist who organized Utah Physicians For A Healthy Environment, much like Center for Science in the Public Interest who had an opinion and a fax machine?  The three people who declared war on popcorn as an unhealthy snack!  It also included two women from Utah Mom's For Clean Air, in which the founder Cherise Udell the groups founder, (not a Utah native by the way), telling us how the inversion hurts kids and causes autism!  Ms. Udell is also a member of Earth Justice, a group of lawyers making it their mission to bilk the taxpayer out of millions by taking businesses and property owners alike to court.  Just thought you should know WHO is behind these efforts.

The majority of those who spoke were in opposition, business owners who supply wood to the public a chimney sweep and Joe Citizen alike.  It was nice to hear the economic impact this would have on small business, and this in tern focused on the burden restaurant and fast food industry.  MANY opposed the wood burning ban but just pointed their big finger at something else, diesel trucks, trains, cars, air planes, geoengineering and state vehicles.  Although I do wonder what the real impact having the Salt Lake International Airport smack dab in the Salt Lake Valley has on the air quality, you never hear a peep from anyone about it!  You have to remember, it is the "Crossroads of the West!"  It was revealed by someone who was in attendance at the Tooele Meeting that, "according to the representatives, this is a done deal!"  And, "we have been referred to as the low hanging fruit."  And, "wood burning only accounts for 5% of particulates."  No one went the property rights angle I wished to take.  The supposed "experts" kept referring to junk science saying, "it's settled", which brought reaction from the crowd, as to which the woman conducting the meeting scolded and told us she wouldn't tolerate reaction of the sort.  I was frustrated by the fact that almost everyone who opposed the regulation told of how THEIR fireplace was certified by the EPA and thereby cow-towing to the board, paying homage to the system that is hellbent on strangling their private property rights.  It did bring a laugh when one person pointed out how they arrived at the meeting early and made note of the FOX13 van outside running it's engine the whole while people were arriving, and just to witness, as I was one of the last people to exit the building they were sitting in their van again with the engine running!  I don't care what they do, but I did find it funny do to their piece on the news that evening.  There was an Indian woman from a local tribe who stood to inform the governor that his regulation would violate tribal law.  And, a few people pointed out the fact that the Indians who used to inhabit this valley anciently used to refer to it as the "Smokey Mountains."  Another score for my pointing out we have a topography problem not a pollution problem!

To whom it may concern,

I would publicly like to voice my opposition to the ban on solid fuel/wood burning proposed by Governor Herbert and the Utah Division of Air Quality.  I am opposed to any requirement to resister a fireplace or wood stove with any government agency.  I am opposed to the taxes, fees, penalties and additional costs that this regulation would require.  I oppose this regulation as it infringes on private property rights enshrined in our founding documents.

Justice Richard B. Sanders, Washington State Supreme Court said, "Our state and most other states define property in an extremely broad sense.  Property consists not merely in it's ownership and possession, but in the unrestricted right of use, enjoyment, and disposal.  Anything which destroys any of these elements of property, destroys the property itself.  The substantial value of property lies in it's use.  If the right of use be denied, the value of the property is annihilated and ownership is rendered a barren right."

The fact is that the truth about CO2 has been turned upside down.  There is actual science that supports this fact.  The Committee For A Constructive Tomorrow released a report of actual experiments and data were collected that proves that Carbon Dioxide in the "Gas of Life!"  It shows how the increase in CO2 as high as 800 ppm increased plant growth, helped prevent disease and damage do to drought conditions.

If the regulatory agencies really wanted to do something about the air quality I would suggest they look up!  The truth is this there are geoengineering projects going on in the skies of Utah.  The governors budget includes earmarks of $800.000.00 per year for it's schemes in which silver iodide is put into our air, water and landscapes.  The US Governments program has been on steroids since the inauguration of our new president in which other heavy metals are being dumped in our air.  Proof of these programs can be obtained at Geo Engineering Watch.org.

The US Senate Committee on Environment and Public Works released a report July 30, 2014 entitled: "The Chain of Environmental Command: How A Club of Billionaires and Their Foundations Control the Environmental Movement and Obama's EPA", which is readily available on the Internet.  It details the mechanisms and methods of a far-left environmental machine that has been erected around a small group of powerful and active millionaires and billionaires who exert tremendous sway over a colossal effort.  The report covers only a small fraction of the amount of money that is being secreted and moved around.  The Billionaires Club operated in relative obscurity hidden under the guise of "philanthropy" as it intended to mislead the public and create "phony science" and propagandize it through their media sources, until uncovered by this committee.

The fact is regulation enacted by EPA edict has fostered the loss of our freedoms and in many instances, has resulted in losses of life and property.  In the case of CAFE Standards alone, depending on weather you use the Brookings Institutes study or the USA Today findings for every 500-lb of weight reduction fatalities increased by 2,200-3,900 and serious injuries by 11,000-19,500 per year.  Add those numbers up per year.  If we applied these numbers to any third world country we would considered it genocide! 

In short, I do not consent to private property rights being infringed.  Private Property Advocate Wayne Hage said, "If you don't have the right to own and control property then you are property."  And John Adams said, "The moment the idea is admitted into society that property is not as sacred as the law of God, and that there is not a force of law and public justice to protect it, anarchy and tyranny commence."

Salt Lake County Health Department is moving forward but will not fine offenders until January 1, 2016!    Done Deal?  Seems so!  Salt Lake County Mayor Ben McAdams announces SLCOHD decree to police the matter and assess fines.  Proof that non-elected groups make regulation/laws that trample on personal property rights and are in the business of imposing taxes, collecting fees and penalties, and conducting unlawful inspections in the name of the "public good." The regulation is now on the books!  (PDF viewing available)  We have so many agencies within our local, state and federal government, and there is so much crossover.  They are stepping on each others toes to wield power over us!  Like a wise man once said, "when you have a hammer, everything looks like a nail."  Truth is environmental activism and the propaganda they create is BIG BUSINESS!  Here are the top 15 on the Billionaire's Club funding to key environmental activist organizations (from page 22).


Although I planned on including a link to the audio archives of the DAQ Public Comment Session in SLC, I have scoured their site and have been unsuccessful at finding the audio or a transcript of the meeting.  The woman conducting the meeting that evening told everyone that they would have the archives updated by the following day.  When I find it, I will update this post to include it.
