"I am asking for any and all media outlets to contact me if you are willing to conduct an interview where I share some important court documents. Documents that were withheld from both the original Grand jury as well as the first jury who convicted Greg Burleson and Todd Engel in the case of the USA VS Cliven Bundy et al. Also, testimony that was willfully altered and manipulated by the US Prosecutors to make something appear different than the facts.

Nevada Federal Judge Gloria Navarro Holds Second BLM Whistle-blower Memo by Larry Wooten Under Seal!

 

 

Ammon Bundy released a statement regarding a second memo from Whistle-blower Agent Wooten that has been sent to the DOJ, the Prosecution and the Defense Attorneys in the Cliven Bundy et al Trial in Nevada.

 

"Many of you will remember the first Wooten memo during the trial that exposed BLM Agent Dan Love's kill list, the snipers pointed at the protesters, the undisclosed 24 hour surveillance of the Bundy ranch, the prosecutorial misconduct of Steve Myhre surrounding this hidden discovery and much, much more. Shortly after the 1st memo was released, a mistrial with prejudice was ruled by Judge Navarro.  It was proven that the original grand jury indictment was filled with complete lies and yet no charges have been filed against those involved in this conspiracy. Hundreds of millions of tax paying dollars have been wasted incarcerating the innocent and trying men on false accusations. Two men were even convicted during the first trial on these false charges. Greg Burleson and Todd Engel. Others plead out under duress and coercion and men like Jerry DeLemus is in prison for this today.

 

Well, we have whistle-blower memo #2 that has been sent to the DOJ, the Prosecution and the Defense Attorneys, and it is currently under seal. Our question is always the same: "Why hide the truth"? Todd Engel, convicted in Trial #1 "The Gunmen", is reporting that his Attorney Warren Markowitz and staff have been allowed to view the second Wooten Letter and take notes.  Todd was unable to disclose the information that was passed on to him through his Attorney, but is asking that the public contribute funds to secure the right to Depose Larry Wooten in order to use the information he disclosed in his second memo as evidence to clear all defendants in the Bundy Cases including those who entered into plead deals before trials began and throughout the trial process.  Engel reported that the Prosecution is referring to Wooten Memos as "hearsay" and will not give any credence to his claims rendering them null in Engel's defense.  Engel also reported that "the Prosecution withheld enormous amounts of exculpatory evidence" during each of the trials. 

In a telephone call in an attempt to "get the word out" about the opportunity to Depose Wooten, which may lead to deposing Wooten's boss at the BLM Kent Kleman, Steven Myhre former DOJ US Prosecutor Nevada who tried the three trials, and Neil Kornze the "linchpin" in the Bundy Ranch Entrapment Scheme linking Dan Love, Steven Myhre, Rory Reid, China Solar, Bureau of Land Management and the Department of the Interior with Harry Reid who made sure Gloria Navarro was appointed as a Federal Judge in Nevada.  Engel, referring to himself as big game that cost the United States Government $500 million to bag, "stuff and mount on the wall" and is asking the public's help in order to raise the funds that would provide the ammunition the legal team need in their Reconsideration efforts FINALLY being addressed by Judge Gloria Navarro after 3 months!  Attny Warren Markowitz said of the second installment of Wooten Letter number 2, "Wooten #2 is an indictment against the BLM's policies, procedures and operations, and makes Wooten #1 look like a bedtimes story and Wooten #2 the Ammityville Horror Show"!  The Defense say they have a copy of Larry Wooten's second letter in allies hands and hope it will be released to the public within a couple of weeks.

A federal judge ruled Monday that the federal government may not retry Cliven Bundy and his sons after rebuking prosecutors for withholding evidence during their felony trial stemming from an armed standoff four years ago.

U.S. District Court Judge Gloria Navarro declared a mistrial in the case last month, saying federal prosecutors willfully withheld evidence that lawyers for the Bundys and alleged co-conspirator Ryan Payne should have had access to while mounting their defense.

She said the attorneys were in violation of the Brady rule, which requires prosecutors to disclose evidence that could be favorable to a defendant, and told them it wasn’t possible to proceed with the case.

On Monday, she dismissed the case “with prejudice,” meaning the government cannot retry the defendants. "The court finds that the universal sense of justice has been violated," Navarro said.

It was yet another defeat for the federal government at the hands of the Bundy family, who have managed to elude prosecution in high-profile trials centered around standoffs with law enforcement over access to public land.

Twice this year, Las Vegas juries acquitted or deadlocked on felony charges against Bundy supporters. Ammon Bundy, 42, and Ryan Bundy, 44, both beat federal felony charges in a case stemming from a 41-day standoff at an Oregon wildlife preserve two years ago.

In the most recent case, the prosecutors alleged Bundy and his sons riled up supporters after the federal government came to remove grazing cattle from U.S. Bureau of Land Management property outside Bunkerville, Nev., in 2014. The government said the Bundys’ incendiary language and actions led to the armed standoff outside the family’s ranch about an hour north of Las Vegas.

The four defendants were charged with threatening a federal officer, carrying and using a firearm and engaging in conspiracy -- felony counts that could send them to prison for decades.

Despite the mistrial, federal prosecutors argued in a legal brief filed Dec. 29 that they didn’t willfully withhold evidence from the defense and they still planned to press ahead with another trial.

Assistant U.S. Atty. Steven Myhre wrote in his brief that the government shared 1.5 terabytes of information and noted it was “by far, the largest review and disclosure operation in this [U.S. attorney’s office] history.”

Myrhe also argued the government needed to protect some witnesses from leaks that might lead to threats, so it “culled the database with witness protection in mind.”

“Unprecedented database volume and witness concerns aside, the government never let these obstacles stand in the way of diligently working to fulfill its discovery obligations,” he wrote.

But defense lawyers for Payne — Renee Valadares, Brenda Weksler and Ryan Norwood — argued in their Dec. 29 briefing seeking to dismiss the case that government “failed to accept responsibility for any of its failure to disclose evidence” and the withholding of evidence was “flagrant prosecutorial misconduct.”

“The government’s irresponsible and, at times, false proffers to this Court as well as its dismissiveness toward the defense inspires no confidence in the prospect of fairness,” they wrote. “A dismissal is necessary to remedy the constitutional violations, to preserve the integrity of this court’s processes, and to deter future misconduct. Anything short of a dismissal is tantamount to condoning the government’s behavior in this case.”

The case has fueled anger and mistrust among groups that view the federal government as overzealous and overreaching in using its power and authority to squash free speech and states’ rights.

Several times during the Trial of the Tier 1 Defendants I wondered, "Who are you?  And, what have you done with Judge Navarro"?  As she sometimes sided on the side of reality and the constitution.  It is my opinion that, in this incident, Steve Myhre's replacement for Nevada DOJ, Dayle Elieson, furnished Judge Navarro a copy of the statement she made in conjunction with this case being dismissed, and with no uncertain terms, told her to do it.  Although it was Judge Gloria Navarro that read it, I don't think she prepared it, and I suspect AG Jeff Sessions Office was instrumental in "bringing Navarro to her senses" so to speak.

Nevada DOJ Filed two motions in District Of Nevada Federal Court today asking Judge Gloria Navarro to dismiss the case against the remaining defendants in Tier #2, who have yet to go to trial, which includes Mel Bundy, Davey Bundy, Jason Woods and Joseph O'Shaughnessy.  Dayle Eleison, Stephen Myhre, Daniel Schiess and Nadia Ahmed are seeking a Dismissal With Prejudice ruling from Judge Navarro.  It is expected that Judge Navarro will accommodate the request, which means all charges are dropped and the DOJ cannot come back at the men for prosecution, UNLESS you are a Defendant from Tier #1, in which Judge Navarro ruled to dismiss that case WITH PREJUDICE a month earlier.  Demonstrating that no matter the ruling according to procedure and presidence if the government wants a "do over" it's going to ignore the ruling and proceed as if everything outlined in Judge Navarros used words like "flagrant" and "reckless" in her ruling sighting Prosecutorial and FBI Misconduct and willfully withholding evidence, known as Brady Violation.  This included footage from surveillance cameras the government had set up around the Bundy's property, Bureau Of Land Management snipers or marksmen, FBI TLC logs and maps, 5 FBI threat assessment reports done on the Bundy Family and the IOG Report among others.  Judge Navarro told the court that the Prosecution violated Due Process which began the eve of the trial.  Judge Navarro spoke of the Discovery that the Defense became aware of and was required to release to the Defense by October 10th.  Judge Navarro told the court that over 3300 additional pages of Discovery have been turned over to the Defense since trial began, which the Defense has not been able to review, just to name a few!  Navarro stated, "the Prosecution has shown a reckless disregard of Constitutional obligations".  But, it's a new day as far as the Nevada DOJ is concerned!  The fact is Myhre is still sulking and steaming after emerging red-faced and shaking from previous court sessions and after Jeff Sessions demoted him and replaced him with a woman!  Myhre is determined to "get blood out of a turnip" and won't rest until he has a second chance at trying to shut the defendants up, as was his goal in the previous trials.  Myhre is determined to "beat his rap" as a failed and corrupt Prosecutor for Nevada, as there has been no action against him as the Ninth Circuit Court recommended that "the strongest sanctions available" be applied as Myhre as he exhibited "prosecutorial misconduct in it's highest form".

Cliven Bundy The Last Rancher Standing As A Result Of BLM "No Moo By 92' Cattle Free By 93'" Policy

 

In an effort to help educate the public as three tiers of defendants go to trial and jury selection begins today in Las Vegas Nevada for Tier 3 the following background information is provided.

A long-time dispute between local rancher Cliven Bundy and the federal government over grazing cattle on the southern Nevada deserts nearly came to a head last week. At the last minute on Wednesday April 11 2012, BLM officials in Washington D.C. pulled the plug on an operation that would have rounded up and impounded hundreds of Bundy’s cattle ranging over thousands of acres of northeastern Clark County. Bundy’s ranching operation is based out of his Riverside home just south of Bunkerville along the Virgin River.

The BLM gather had been in planning for months, according to Bundy. During recent conversations with Sheriff Doug Gillespie, Bundy had learned that the BLM planned to enforce an impound notice which had been issued in July 2011. The cattle were scheduled to be gathered and removed from the land on by contract cowboys Catoor Livestock Roundup, Inc., Bundy said.

On Monday afternoon, April 9, as the situation became more volatile, Bundy and his family sprang into action. They contacted family, friends and sympathetic organizations to notify them of the situation. They also contacted the local and regional press.

In addition, Bundy sent notice to the Catoors, the Sheriff, the Clark County Commissioners and other state elected officials; promising to hold them liable for any loss of his cattle or equipment in the raid. In the notice, he urged the Sheriff to “say NO to this unconstitutional power without limitation seizure”.

“Cliven Bundy will do whatever it takes to protect his property and rights and liberty and freedoms and those of We the People of Clark County, Nevada,” the notice stated.

In an interview with the Progress, Bundy said that he had been willing to defend his rights at all costs. When asked whether the matter might have come to violence he said, “Why not? I’ve got to protect my property. I have a right to life, liberty and property.”

But within 24 hours of Bundy’s notice, the BLM backed down. Bundy reported receiving another phone call from Sheriff Gillespie.

“He said he’d gotten a call from Washington that they were not going to do it,” Bundy said. “They were calling it off. He told me to go ahead and go back to ranching.”

BLM Southern Nevada District Manager Mary Jo Rugwell told the Progress Wednesday afternoon that the BLM had decided not to proceed with the impoundment operation and instead would move forward with legal action.

“We will work with our solicitor to put together a case that describes what the effects of the long-standing trespass have been,” Rugwell said.

Last year the BLM conducted a cattle count in the region to determine how many of Bundy’s cattle were in the area, Rugwell said.

“The first count in March of 2011 found over 900 cattle out in that area,” she said. “It was a lot more than we thought we’d get.”

Multiple letters were sent to Bundy over the past year requesting that he voluntarily remove the livestock from the area, Rugwell said.

“Our goal all along has been to get the cattle out of the area in a safe way,” she said.

Rugwell said that the cattle have been causing damage to vegetation and cultural resources in the area. Much of the range-land in question is under a special federal designation as habitat for the endangered desert tortoise.

“The problem is that the cattle adversely affect vegetation in the area,” Rugwell said. “Yes, tortoise burrows can also be crushed by the cattle. But mainly the vegetation is what the tortoise counts on to have a healthy population.”

Rugwell also claimed that the cattle pose a safety hazard to other people using the public lands.

“The cattle are wild and are not really managed,” Rugwell said. “So they get on roadways, get into other people’s private property and they can be dangerous to people. It’s not a good situation in terms of health of the land and safety of the public.”

Bundy dismisses the claim that the cattle are damaging tortoise habitat. He states that there has been absolutely no proof that the tortoise is affected by cattle on the range.

He also admits that his cattle have roamed beyond the lands that he claims as his grazing allotment. As the waters of Lake Mead have receded, Bundy’s cattle have been found to have roamed across the Muddy River and onto National Park Service lands at Lake Mead.

But Bundy says that Nevada is a ‘fence-out’ state in its laws.

“According to Nevada law you don’t have to fence your cattle in, you have to fence your neighbor’s cattle out,” Bundy said.

Years ago, when ranching in Clark County was common, this law worked well, Bundy said. Neighboring ranchers built fences to establish the boundaries of their allotments, he said.

“Now the ranchers are all gone but me,” Bundy said. “No one has been maintaining those fences.”

But Rugwell said that, aside from all of this, the heart of the matter for the BLM is one of fairness.

The BLM claims that Bundy is grazing his cattle on public lands wholly without authorization. Rugwell explained that Bundy fell out of compliance with grazing regulation as far back as the early 1990s when the desert tortoise was listed as endangered, (therefore the BLM slogan “No Moo By 92’, Cattle Free By 93’). Grazing permits, which were issued then in ten year increments were re-analyzed and adjusted at that time to reconcile the needs of the tortoise, Rugwell said.

“Mr. Bundy did not accept those adjustments,” Rugwell said. “He just said: ‘I’m not going to pay my grazing fees anymore’.”

Later, in 1997, Clark County, as part of its Multiple Species Habitat Conservation Plan (MSHCP), offered to purchase all the existing grazing permits from Clark County ranchers and then retired all the existing grazing permits. Bundy refused to sell his rights. But the entire allotment was still retired at that time, Rugwell said.  This is why Cliven Bundy bares the title “Last Rancher Standing”.

“The result is that there is no authorized grazing on any of the area,” Rugwell said, despite Cliven Bundy’s refusal to forfeit his property rights, the BLM just usurps them.

But Bundy insists that he has retained his rights to ranch on the land. He does not accept federal jurisdiction over his various ranching rights and maintains that the county and the state have policing power in the matter.

“I have pre-emptive rights through beneficial use,” Bundy said. “Those include rights for forage, water, access and range improvements. I believe in Nevada’s sovereignty over them as stated in the 10th amendment.”

Bundy’s water and range rights originate with his grandfather who began ranching the area in 1877. Since then, Bundy has either bought or inherited other rights which, he says, includes allotments over 120 square miles in the Virgin Mtn. range, the eastern side of the Mormon Mesa, the Toquop wash area, and some areas south of Bunkerville.

Bundy explained that, before the tortoise was listed as endangered, he paid grazing fees regularly to the BLM.

“Those grazing permits were a signed contract,” Bundy said. “They were a fee for service to manage and administer my rights to ranch on the land.”

But as the tortoise increasingly came into the picture, Bundy, who at the time served on the State Grazing Board, noticed that the arrangement seemed to be changing.

“I could see that the BLM was not managing the land for multiple use,” Bundy said. “Instead they were working to eliminate agriculture and other uses. When I figured out where the money was going I sent them a notice essentially firing them. I wasn’t going to pay them to manage my ranch out of existence.”

In response, 14 years ago, the federal government took Bundy to court and prevailed. The decision found Bundy in Trespass and it levied a heavy fine of $200 per day per cow on the land. Bundy expected an appeal to the Supreme Court by the state of Nevada who he said should have proclaimed its sovereignty in the matter. But nothing was ever done about it. Meanwhile, Bundy just kept ranching.

“This has gone on for 14 years,” Bundy said. “I’ve just kept going. They couldn’t collect and they never did collect.”

Bundy sees the issue as larger than just himself and his own grazing rights. It involves all of the public of Clark County, he says.

“I’m the last man standing,” he said. “I’m the only one left who is exercising pre-emptive and invective rights anymore. Right now Clark County has policing power over those rights. If they get rid of Cliven Bundy, the land is just federal land and they will exercise unlimited power on it. The public won’t have anything to say about road closures or access. This is as much the people’s battle as it is mine.”

For now, at least, the crisis seems to be over. Bundy is unsure of what the next steps will be. But whatever comes down the pike, he is determined to keep up the fight to the end.

“Despite all of the legal struggles of the past 14 years, I have still been successful in the livestock industry when everyone else was gone,” Bundy said, “And I was successful this morning, too!”

Via Angie Bundy FB ~ "Just a few of my observations from Cliven's hearing yesterday...he objected over and over that Prosecutor Myhre was in attendance with an assistant. They (prosecution team) were also in attendance for Ryan's hearing that he wasn't transported to. Why do they need to be involved with who represents our side legally? What happened to choosing our legal assistance? Cliven fired his attorney, but was told yesterday that he couldn't, by Magistrate Leen. It's my opinion that the Prosecutor is running this show, and these judges and magistrates need him present to make decisions. Also, Cliven has been an incredible Grandpa and Father. We love and miss him. He is capable of making decisions for himself. He is very aware of his rights, and that is really what this case is about. Our family knew our rights, and simply protested when they were being violated. But happy Thursday my friends...God is still in charge 😊"

Maybe this is news to you.  There are over 40 men and some women being held IN PRISON before trial, mostly in the western states, in connection to the STAND UP in Bunkerville Nevada and Burns Oregon.  The US Attorney's Office, in conjunction with the US Marshall's, are holding them against their will and depriving them of their Constitutional Rights!  

• In order to be imprisoned, you must be guilty of a crime, verdict being handed down by a jury of 12 of your peers, not a judge!  They have not been given their right to a speedy trial!  

• You must first have committed a crime causing injury to a man, not a government!  They committed none!  

• They MUST be allowed to prepare for their own defense.  They are being denied communications while in prison with those who are helping to defend them, even refusing to forward legal documents and communications from council!  

The US Attorney's Office have cast their "vindictive dragnet" pronouncing them, "guilty before proven innocent!"  Violating their 1st Amendment, 2nd Amendment, 4th Amendment, 5th Amendment, 6th Amendment, and 8th Amendment rights!

 

I am asking you to CALL the US Attorney's Office, a short 10 minutes is all it takes!  Please be courageous and courteous as you call and kindly ask to speak to US Attorney Williams.  If he is not available, leave a message for him by explaining your grievances to the person on the phone.  Try to avoid being directed to use email.  The person answering the calls may tell you they are not the person or department you need to speak to.  Ask them, "with whom do you recommend I speak to"?  This is just their attempt to silence us.  Call at least once a day.  We must be persistent in order to be effective.  Ask your friends and family to help in our efforts to effect a release of our neighbors and fellow American's.  Share this post on social media and email to your fellow Utahan's especially, we have members of our community being fed to the wolves by our unconstitutional Sheriffs and complicit bureaucrats.  Use the short "cheat sheet" below and come up with a few points of your own.  Educating the US Attorney's Office on the Constitution is the first step.
